2. Eligibility

• You must be at least 18 years old to use the Service. By creating an account, you represent and warrant that:

3. Account Registration and Security

• Impersonate any person or entity or misrepresent your identity or affiliations.
• Post or transmit content that is illegal, obscene, exploitative, violent, defamatory, or infringes privacy or intellectual property rights.
• Upload viruses, malware, or harmful code or interfere with the security or functionality of the Service.
• Data mine, scrape, crawl, or use bots or other automated means to access, collect, or index the Service without written permission.
• Use the Service for commercial advertising, fundraising, or solicitation without our prior written consent.
• Circumvent technological measures, access accounts or data without authorization, or attempt to probe, scan, or test vulnerabilities.
• Engage in doxing, threats, extortion, or any behavior that puts other users at risk.
• Share minors’ content or attempt to use the Service if you are under 18.
• We may remove content, restrict features, or suspend or terminate accounts that violate these Terms or applicable laws.

5. Moderation and Enforcement

• Soul2Search uses a combination of automated tools and human review to moderate content and behavior. We may:

  • Suspend or terminate accounts.
  • Report illegal content or conduct to law enforcement where appropriate.
• Moderation decisions are made at our reasonable discretion to foster safety, integrity, and compliance. You may contact support@soul2search.com to appeal moderation actions, though we do not guarantee reversal.

6. Location Services and Device Permissions

• The Service may use precise device location (GPS) to enhance discovery and safety features. You can control location permissions via your device settings.
• Disabling location may limit certain features (e.g., proximity-based matches). See the Privacy Policy for more details on location data handling.

7. Analytics, Third-Party Services, and Integrations

• We use analytics, messaging, moderation, matching, and infrastructure services to operate and improve the Service. We may share limited personal data with such providers under contractual safeguards.
• Your use of third-party features may be subject to those providers’ terms and privacy policies.

8. Messaging and Communications

• The Service includes messaging between matched users. We do not tolerate harassment, abuse, threats, or illegal content in messages.
• We may (i) scan or process messages using automated tools for abuse detection, spam prevention, moderation, or safety; and/or (ii) review messages in limited cases to enforce these Terms or comply with law.
• We may send you service-related communications (e.g., security alerts, account notices). You can manage certain marketing communications via settings or unsubscribe links.

9. Intellectual Property; Our License to You

• The Service, including software, interfaces, trademarks, logos, and content (excluding User Content), is owned by 18Tree LLC or its licensors and protected by intellectual property laws.
• We grant you a personal, non-transferable, non-sublicensable, revocable, limited license to use the Service solely for its intended purposes and in accordance with these Terms.
• You may not copy, modify, distribute, sell, reverse engineer, or create derivative works of the Service except as expressly permitted by law or these Terms.

10. In-App Purchases, Subscriptions, and Payments

• At launch, the Service does not include paid subscriptions or in-app purchases; these may be added in the future.
• If paid features are introduced:
• • We will clearly describe pricing, billing intervals, and features prior to purchase.
  • Unless otherwise stated, subscriptions will auto-renew until canceled in accordance with platform policies and our then-current terms.
  • Refunds, if any, will be handled per applicable law and platform rules. Some purchases may be nonrefundable.

11. Third-Party Links and Content

• The Service may contain links to third-party websites or resources. We are not responsible for their content, policies, or practices, and you access them at your own risk.

12. DMCA Notice and Procedure; Repeat Infringer Policy

• If you believe content infringes your copyright, please send a DMCA notice containing:

  • Identification of the infringing material and information reasonably sufficient to permit us to locate the material.

• Counter-notices must comply with the DMCA. We may terminate users deemed repeat infringers.

13. Feedback

• If you provide suggestions, ideas, or feedback, you grant us a perpetual, worldwide, royalty-free license to use such feedback without restriction or compensation.

14. Disclaimers

• WE DO NOT CONTROL, ENDORSE, OR ASSUME RESPONSIBILITY FOR USER CONTENT OR THIRD-PARTY CONTENT, AND WE DISCLAIM ALL LIABILITY ARISING FROM YOUR USE OF OR RELIANCE ON SUCH CONTENT.

15. Limitation of Liability

• OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) USD 100 OR (B) THE AMOUNTS YOU PAID TO US (IF ANY) FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

16. Arbitration Agreement and Class Action Waiver

• Governing Law: These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the State of Maryland, without regard to its conflict of law rules.
• Binding Arbitration: You and Soul2Search agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, except that either party may bring an individual action in small claims court in Baltimore County, Maryland.
• Class Action Waiver: You and Soul2Search agree that any proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
• Opt-Out: You may opt out of this arbitration agreement within 30 days of first accepting these Terms by sending an email to support@soul2search.com with the subject “Arbitration Opt-Out” and your account email and full name in the body.
• Venue: For disputes not subject to arbitration (e.g., small claims), the exclusive venue will be the state or federal courts located in Baltimore County, Maryland. You and Soul2Search consent to personal jurisdiction there.

17. Termination

• We may suspend or terminate your account or access to the Service at any time, with or without notice, for any or no reason, including violations of these Terms.
• Upon termination, the licenses granted to you will cease, and your access to your account and certain features may end. Some obligations (e.g., intellectual property, indemnity, arbitration) will survive termination.

18. Changes to the Service and Terms

• We may modify, suspend, or discontinue all or part of the Service at any time.
• We may update these Terms from time to time. Material changes will be posted on the Service or communicated to you. Your continued use after changes become effective constitutes acceptance of the revised Terms.

19. International Use; Export

• You are responsible for compliance with local laws. We do not represent that the Service or content is appropriate or available in your jurisdiction.
• You agree to comply with U.S. export and sanctions laws and regulations and not to use the Service in violation of such laws.

20. Electronic Communications; Notices

• You consent to receive communications from us electronically and agree that emails, in-app messages, and notices posted on the Service satisfy any legal requirement that such communications be in writing.
